1. Acceptance of Terms & Provider Identity

By accessing or using the SunUp mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is provided by:

2. Contract Language

The contract language is English.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has consented to your use.

4. Account Registration

You may create an account using email, Google, or Apple sign-in. You may also join events as a guest without registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you become aware of any unauthorized use of your account.

5. Right of Withdrawal

If you are a consumer within the meaning of § 13 BGB (a natural person acting for purposes outside your trade, business, craft, or profession), you have the following right of withdrawal:

Withdrawal Policy

You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period expires fourteen (14) days after the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will delete your account and all associated personal data in accordance with our Privacy Policy. If you consented to the commencement of the Service during the withdrawal period, you may owe us a proportional amount for the service already provided up to the point of withdrawal, to the extent that monetary consideration was involved.

Premature Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely if we have fully provided the Service and began performance only after you gave your express consent and simultaneously confirmed your knowledge that you lose your right of withdrawal upon complete performance by us.

6. User Content

You retain ownership of all photos and media ("User Content") you upload to the Service. By uploading User Content, you grant Haukel GbR a non-exclusive, worldwide, royalty-free license to store, display, and distribute your User Content solely within the context of the events you participate in and for the purpose of providing the Service. This license ends when your User Content is deleted from the Service.

You represent that you have the right to upload any User Content and that your content does not violate any third-party rights or applicable laws.

7. Prohibited Conduct

You agree not to:

• Upload content that is illegal, harmful, abusive, or violates the rights of others
• Use the Service to harass, stalk, or intimidate others
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means to access the Service without our prior written consent
• Upload malware, viruses, or other harmful code

8. Intellectual Property

The Service, including its design, logos, trademarks, and all software, is the property of Haukel GbR and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Event Hosts & Participants

Event hosts are responsible for managing their events and the conduct of participants within them. We are not responsible for User Content uploaded by participants or for disputes between hosts and participants.

10. Termination

You may terminate your use of the Service and delete your account at any time through the App settings.

Haukel GbR may terminate or suspend your access to the Service for important cause (wichtiger Grund), in particular if you:

• materially or repeatedly breach these Terms;
• engage in prohibited conduct as defined in Section 7;
• use the Service in a way that endangers the security or integrity of the Service or other users.

Haukel GbR may also terminate your access to the Service without cause by giving you at least 30 days' prior notice by email or through the App. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (in particular User Content licenses already granted to other event participants, Liability, and Governing Law) shall continue to apply.

11. Liability

Haukel GbR shall be liable without limitation for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty by Haukel GbR, its legal representatives, or its vicarious agents.

Haukel GbR shall be liable without limitation for damages caused intentionally or through gross negligence by Haukel GbR, its legal representatives, or its vicarious agents.

In the event of a slightly negligent breach of a material contractual obligation (Kardinalpflicht — an obligation whose fulfillment is essential to the proper performance of the contract and on whose compliance you may regularly rely), Haukel GbR's liability shall be limited to the foreseeable, typically occurring damage.

Haukel GbR shall not be liable for damages arising from a slightly negligent breach of non-material contractual obligations.

The above limitations of liability shall not affect liability under the German Product Liability Act (Produkthaftungsgesetz) or any other mandatory statutory liability.

Haukel GbR does not guarantee uninterrupted or error-free availability of the Service. Temporary interruptions may occur due to maintenance, updates, or circumstances beyond our reasonable control. We will make reasonable efforts to minimize downtime and, where foreseeable, notify you of planned maintenance in advance.

12. Changes to Terms

We may modify these Terms with effect for the future. We will notify you of any proposed changes at least six (6) weeks before their intended effective date by email or through a prominent notice in the App.

The notification will describe the nature of the changes and inform you of your right to object. If you do not object to the proposed changes within the six-week notice period, the amended Terms will be deemed accepted. We will specifically inform you about this consequence of non-objection in our change notification.

If you object to the changes, the previous Terms will continue to apply. In such case, we reserve the right to terminate the contract with reasonable notice in accordance with Section 10.

Material changes to the core of the contractual relationship (in particular the nature and scope of the Service) require your express consent.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer within the meaning of § 13 BGB, mandatory consumer protection provisions of your country of habitual residence shall also apply where they provide greater protection. You may bring claims against Haukel GbR either in the courts of your domicile or the courts competent for the registered office of Haukel GbR. Claims by Haukel GbR against consumers shall be brought only in the courts of the consumer's domicile.

If you are not a consumer, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Schwäbisch Hall, Germany.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the economic intent of the invalid provision.
